Terms and Conditions for Accommodation Contracts

1. Scope of Application
① Contracts for accommodation to be concluded between the hostel and guests to be accommodated shall be subject to these terms and conditions. And any particulars not provided herein shall be governed by applicable laws and regulations or generally accepted practices.
② In the case when the hostel has entered into a special contract with the guest unless such special contract violates any applicable laws and regulations and generally accepted practices, in spite of the preceding paragraph, the special contract shall take precedence over the provisions of theses terms and conditions.
2. Application for Accommodation Contracts
① An application for an accommodation contract shall be made on this website or other booking websites that the hostel has contracted with or via reception of the hostel.
② In the case when the under 16-year-old guest intends to make an application for an accommodation contract, his/her legal guardian shall be requested to accompany and stay with him/her.
③ In the case when extension of accommodation is requested during his/her stay beyond his/her original accommodation date, it shall be regarded as an application for new accommodation contract at the time when the request is made.
3. Conclusion of Accommodation Contracts
① A contract for accommodation shall be deemed to have been concluded at the time when a booking page is proceeded to a booking completed page regardless of whether confirmation mail is successfully sent or failed to be sent due to failure to input accurate e-mail address or spam registration of the email account of guest.
② Since an accommodation contract has once been concluded in accordance with provisions of the preceding paragraph, free cancellation is available until 7 days prior to arrival date in accordance with an applied accommodation contract.
③ In the case when a cancellation is requested within 7 days prior to arrival date in accordance with an applied accommodation contract, 100% of the total amount to be paid for accommodation shall be paid by the guest as cancellation charge by due date indicated on the issued invoice at the time when application for cancellation is submitted in accordance with provisions of Cancellation Policy.
4. Refusal of Accommodation Contracts
The hostel may refuse the conclusion of accommodation contracts in the case of one or more of followings.
① When the accommodation seeker does not agree to provisions of these terms and conditions.
② When the hostel is fully booked and no room or bed is available.
③ When the hostel cannot provide lodging or basic supplies due to severs damages caused by natural disaster or any other causes.
④ When the accommodation seeker deemed liable to conduct himself/herself in a manner which will violate applicable laws and regulations or act against public order or morality.
⑤ When the accommodation seeker is considered to be corresponding to the followings (a) to (c).
(a) The law in respect to prevention, etc. against illegal actions by gang members (1991 Law item 77) stipulated article 2 item (hereinafter refereed to as “gang group”), gang member stipulated by the same law article 2 item 6 (hereinafter refereed to as “gang member”), gang group semi-regular members of gang members related persons and other antisocial forces.
(b) When gang group or gang members are associates of corporations or other bodies to control business activities.
(c) When a corporate body has related persons to gang members.
⑥ When the accommodation seeker is deemed liable to conduct himself/herself in a manner which will cause serious inconvenience or annoyance to other guests of the hostel.
⑦ When the accommodation seeker is clearly detected to be infected with epidemic disease.
⑧ When the accommodation seeker is deemed liable to carry ignitable objects.(gas, fuel, etc.)
⑨ When the accommodation seeker is in a state of intoxication, etc. and is deemed to be unable to behave himself/herself.
⑩ When the hostel receives threatening demands or is requested to assume unreasonable burden in regard to accommodation.
⑪ When the guest is found smoking in non-smoking area during his/her stay.
⑫ When the accommodation seeker has ever been refused to be accommodated due to one or more of preceding particulars.
5. Occupancy Hours of Room and Bed
① The guest is entitled to occupy the contracted room and bed of the hostel from 4 p.m. on arrival day to 11 a.m. on departure day.
② In spite of the provisions stated in the preceding paragraph, the hostel may permit the guest to occupy the room and bed beyond the time stated in the same paragraph with surcharges to be paid.
6. Observance of Use Regulations
The guest shall observe the use regulations established by the hostel, which are posted within the property of the hostel.
7. Payment of Accommodation Charges
① In the case that the contract for accommodation is made on this website or other booking websites, accommodation charges shall be pre-paid at the time of reservation or paid at on-site reception of the hostel at the time of arrival by credit cards or Japanese currency.
② Nevertheless the hostel provides the contracted room and bed and the guest waive contracted stay at will, accommodation charges shall be paid.
8. Handling of Deposited Articles
In the case the deposited article at the reception by the guest is lost, damaged or breaks, the hostel shall confirm kind of the article, estimate damage and compensate the guest except for when this has occurred due to causes of force majeure. And compensation shall be limited to ¥10,000.
9. Custody of Baggage and/or Belongings of The Guest
① When the baggage arrives, the hostel shall liable to keep it at the reception and hand it over to the guest at the time of check-in.
② When the baggage or belongings of the guest is found left after check-out and ownership is not confirmed, the hostel shall keep it for 14 days and discard it.
10. Liability of The Guest
The guest shall compensate the hostel for damage caused through intention or negligence on the part of the guest.

Cancellation Policy

1. General Cancellation Policy
Cancellation request shall be accepted with free of charge when it is applied 7 days prior to arrival date of contracted accommodation. However, when a cancellation is requested within 7 days prior to arrival date of contracted accommodation, 100% of the total amount to be paid for accommodation shall be paid by the guest as cancellation charge by due date indicated on the issued invoice at the time when the cancellation is requested. In addition, if the guest does not appear within check-in hours, 4p.m to 1 a.m, without an advance notice, the guest shall be regarded as No-show and demanded to pay cancellation charge.
2. Cancellation due to Unavoidable Emergency or Natural Disaster
① Cancellation charges shall be exempted nevertheless the application for cancellation is submitted within 7 days prior to arrival date in the case when it is due to followings (a) to (d).
(a) When the cancellation is requested since there is no available transport on the route of between the departure point and the hostel due to natural disasters, such as earthquake, blizzard, tsunami, flood, etc. (if the cancellation is requested due to common traffic delay or cancellation of train, flight, etc. it shall be subject to General Cancellation Policy.)
(b) When the cancellation is requested due to death of a lineal family member.
(c) When the cancellation is requested due to fulfillment of duty of the state.
(d) When the cancellation is requested due to severe or epidemic disease.
② When the submitted event is not confirmed, the hostel shall request related statements from the guest in regard to exemption of cancellation charge.
③ Exemption rate of cancellation charges shall be estimated in accordance with the time of cancellation request from occurrence of the event as follows. In regard to the cancellation request, which is submitted 72 hours after the event occurs, it shall be subject to General Cancellation Policy.

Privacy Policy

1. Collection of Personal Information
① The hostel is entitled to provision of personal information by booking agencies, travel agencies, etc. which the guest has directly concluded a contract with or the hostel has concluded a contract with in regard to an application for an accommodation contract or use of the hostel.
② The hostel shall collect personal information directly from the guest via a phone call, online, etc. or those who have established an alliance with the guest or those who are legally authorized and have concluded a contract with the guest for registration for a package plan, etc.
2. Purpose of Use of Personal Information
The purposes of use of personal information by the hostel includes following
① Collected personal information shall be used for transaction related to facilities or goods of the hostel(accommodation, food, goods sale, sale or offer of incidental goods, service offer, implementation of events).
② Collected personal information shall be used for communication with related third parties for a trade, a contract and the performance of trade, product delivery, transaction, etc.
③ In order to develop provided services by the hostel, Collected personal information shall be used to analyze and grasp current status of use of related services.
④ Collected personal information shall be used for furnishing, filling out and retainment of the hostel guest registration card in accordance with governed laws and regulations.
⑤ Collected personal information shall be used to handle an inquiry or request by the guest.
⑥ Collected personal information shall be used for other particulars under an agreement of the guest.
3. Legal Basis of Use of Personal Information
Use of personal information by the hostel is based on an agreement of the guest as legal basis. In regard to use of personal information without the agreement of the guest, legal basis of use of personal information shall be the followings (a) to (d).
(a) Necessity for performance of the concluded contract between the hostel and the guest
(b) Necessity for procedure of the contract in accordance with a request of the guest prior to the conclusion of the contract
(c) Necessity for justifiable profit of the hostel or third parties
(d) Necessity for the hostel to observe governed laws and regulations
4. Personal Information which The Hostel Collects
Personal information ,which the hostel collects, shall be followings ① to ⑧.
① Basic personal information of the guest(address, name, date of birth, nationality, e-mail address, contact, etc.)
② Additional information(occupation, place of employment, etc.)
③ Payment information(credit card number, billing address, etc.)
④ Service use information(current status of facility use or goods purchase, etc.)
⑤ Contact information(e-mail address, registered information in an accommodation contract, etc.)
⑥ Collected information by use of security systems(security cameras, etc.)
⑦ Automatically registered information by access to the website of the hostel(cookies, IP address, types of browser、access time, etc.)
⑧ Information in the hostel guest registration card(address, name, occupation, nationality, passport number, age, name of previous accommodation, destination, arrival time, departure time, name of guest room, etc.)
5. Collected Personal Information for Accommodation
The hostel shall collect personal information for provision of accommodation. In regard to personal information to be particularly collected for the hostel guest registration card, it shall be archived for 3 years in accordance with governed laws and regulations. In the case that required information is not provided, the hostel shall refuse provision of accommodation.
① Basic information of the guest(address, name, sex, date of birth, nationality, e-mail address, contact, etc.)
② Particulars to be filled in the hostel guest registration card(address, name, occupation, nationality, passport number, age, name of previous accommodation, destination, arrival time, departure time, name of guest room, etc.)
6. Protection and Management of Personal Information
In regard to management of personal information, the hostel takes appropriate management and pays particular attention to prevent unauthorized leakage.
① The hostel takes appropriate and strict measures to prevent unauthorized access, loss, leakage, destruction, alteration, etc. of personal information.
② When the hostel provides personal information of the guest to third parties, the hostel shall select parties, which are deemed in an appropriate personal information management level, and state related particulars to handling of personal information on a contract and pay particular attention to ensure safety.
7. Provision or Disclosure of Personal Information
Personal information shall be provided or disclosed in the case when the hostel has an agreement of the guest or it is requested based on governed laws and regulations. Except for preceding cases, the hostel shall not provide or disclose collected personal information.
8. Transfer of Personal Information located in EEA(European Economy Area:EU member countries, Iceland, Norway, Liechtenstein)
The hostel shall transfer personal information of individuals(hereinafter refereed to as “guest”) whose location is in EEA to Japan in regard to performance of a contract or procedure of a contract in accordance with a request of the guest prior to conclusion of the contract. Japan has not received a decision of European Commission to guarantee sufficient level of personal information protection. However, the hostel, in regard to handling of personal information, provides appropriate protection and security measures to prevent leakage.
9. Retainment Period of Personal Information
Retainment period of personal information shall be subject to fulfillment of Purpose of Use of Personal Information stated in article 2 of Privacy Policy. Afterwards, it shall be safely disposed or anonymized within lawful period in accordance with governed laws and regulations.
10. Request for access, correction or deletion, demand of restriction or formal objection of use, transfer.
The guest has rights, as follows (a) to (f), to the hostel in accordance with governed laws and regulations. The guest is entitled to exercise the right by submission of a request through registered e-mail on the website of the hostel or a inquiry to related department of the hostel. In the case when these rights are exercised to the hostel, the hostel shall confirm identification and sincerely handle the request.
(a)Right to access to personal information in use and related information to the case if his/her personal information is used when he/she checks status of his/her personal information use
(b)Right to correct inaccurate personal information
(c)Right to delete his/her personal information in certain cases
(d)Right to restrict use of his/her personal information in certain cases
(e)Right of formal objection in regard to use of his/her personal information based on justifiable profit required by the hostel or third parties
(f)Right to receive personal information in structured and commonly used mechanically or electronically accepted format and transfer the information to other businesses without interference of the hostel
11. Agreement Withdrawal
The guest is entitled to withdraw an agreement at any time. The withdrawal of agreement shall not affect legality of personal information use in accordance with consent before the withdrawal.
12. Formal Objection to Supervisory Institution.
The guest is entitled to make a formal objection to local, national supervisory institutions or international organizations in regard to personal information handling of the hostel in accordance with Personal Information Protection Act.
13. Presence of Automated Decision-Making(Profiling, etc.)
The hostel shall not make a decision based only on automated information handling methods, such as profiling of personal information.
14. Regulation of Personal Information Handling
The hostel established company regulations to protect and handle personal information in accordance with governed laws, regulations and guidelines. In addition, the hostel shall constantly check and improve the company regulations in accordance with necessity.
15. Compliance with Governed Law and Regulation
The hostel shall comply with governed laws, regulations, norms and company regulations.
